Need HELP Badly!!! G845 not approved
G845 was not approved. I don't understand why. They said they could not verify that I meet the requirements, but instead of asking for more information, they just disapproved my form. Is there a solution?
Here is my problem: I came to the US on student visa (F1) in 2007. I applied for asylum in mid 2009, but kept my student status until end of 2009 (I think it expired at that point because I stopped going to school). I stayed on "ASYLUM PENDING STATUS" with Employment authorization until I was GRANTED ASYLUM this year in June 2012. I think I meet the "asylee" status category and the minimum 2 years residence without any absence of more than 90 days requirements for MAVNI program. So, I don't understand why I would be rejected. PLEASE ANY HELP AND SUGGESTION. My recruiter wants now to resubmit form G845 with copies of all the pages of my passport to prove that I didn't leave the country at any time. But is it going to help? Is there any thing else he should do?
PS: I will be 35 years old by the time I received my Green card next year and won't be eligible. That's why I want so badly to get in the army now. Thanks for help.

I think Asylum pending status is not eligible. I read it somewhere in this forum. That might be the case for you.

I am not Asylum pending. I was granted asylum already as I said above. Thanks for reply flagerr.

I mean you have been granted asylum for less then 2 years since your asylum pending is not counted towards the 2 years requirement.
Hopefully i'm wrong.

i would suggest you speak with USICS, as per Mavni requirements are concerned you should in a status for 2 years without any change of status or pending.it that is correct in your case you should get it approved.Uscis can determine your absensee through your 1-94 or anyother INS form. Again i am not an expert i would sugggest you speak to a lawyer for more details

Thanks ashlal82, I will try every thing possible to solve the problem. But, here is my problem: By the rules of USCIS, after one year with asylum status, you are eligible for green card. So what's the point of asking a 2 years requirement for an asylee!!! I thought living in the US legally for at least 2 years for an asylee would be the requirement. any answer would be appreciate. Thanks.

If you are eligible for a greencard (permanent resident alien) after one year (and you have legally been in that status for two) why not go ahead and get it? Resident aliens are allowed to join the military, just not in a classified MOS or be an officer.

@RIhyatt, As I said above, I will be 35 years old by the time I get the green card in my hands and the new age limit since 2011 to get in the army is now at 35. That's why I'm trying now with MAVNI.

Do you have a pending case for Green Card? how do you know you will be 35 when you get your GC,do you have a priority dates? do you have a if yes, you are not eligible, if no, you might want to check with USCIS and your lawyer.
